A garden association is registered in the form of a service cooperative under the Law “On Cooperation”. The minimum number of founders is three. The document package (meeting minutes, register of members, charter) is processed by the state registrar within 24 hours, after which the association appears in the Unified State Register.
In what form a garden association is registered
According to explanations from state authorities, garden (horticultural) associations belong to service cooperatives and are subject to state registration on the terms set for cooperatives. Therefore the official name usually looks like: Service Cooperative “Garden Association ‘Name'”.
The legal basis is the Law of Ukraine “On Cooperation”. Under it, a cooperative is created by its founders voluntarily, and the decision to create it is taken by the founding meeting.
Who can be a founder
Founders of a cooperative may be citizens of Ukraine, foreigners and stateless persons, as well as legal entities of Ukraine and other states that participate in the cooperative’s activity through their representatives.
The founding meeting and the minutes
Creating the association starts with a founding meeting. Its decision is formalised by minutes signed by the chair and the secretary of the meeting. The minutes state:
- for an individual — full name and passport details;
- for a legal entity — details of state registration (a USR extract) and a document confirming the representative’s powers;
- the decision to create the cooperative, approve the charter and elect governing bodies.
Data on an individual are certified by their personal signature, and on a legal entity — by the signature of an authorised representative.
Document package for registration
For state registration of a garden association, you submit:
- an application for state registration of a legal entity’s formation (in the prescribed form);
- the founding-meeting minutes (original or a notarised copy);
- the register of persons who took part in the founding meeting;
- the approved charter of the cooperative.
How long registration takes
The state registrar processes a complete document package within 24 hours (excluding weekends and holidays). Documents can be filed through a state registrar, a notary or online — including via the Diia portal. Registration of a legal entity’s formation is carried out free of charge.
After the record is entered in the Unified State Register, the head of the cooperative obtains the right to open a bank account. A seal has not been mandatory since 2014 — the association makes one only by its own decision.
